COMPLIANCE & ENFORCEMENT
Where collective agreements are unequivocal in its meaning and effect to the parties, the
employer and trade union parties have an obligation to comply with collective agreements that it
is a party to and this is an essential element of good faith bargaining. The role of trade union representatives and
managers include monitoring the application of the agreement and carrying out agreed
procedures to resolve any problems that arise.
PUBLIC SERVICE SECTOR BARGAINING COUNCIL
The Public Service Sector Bargaining Council (PSCBC) has approximately 1.4 million employees which fall under it.
The PSCBC received a total number of 854 referrals that fell withing its jurisdiction from April 2018 to March 2019
The PSCBC conducted 893 arbitrations/con-arb processes. This comprised of 203 arbitration
awards rendered, 154 postponements, 179 withdrawals, and 175 settlements.
A total of 203 arbitration awards were rendered. 103 (51%) were found in favour
of the unions/employees and 92 (45%) awards in favour of the employer. 8 awards were
neither in favour of the employee nor the employer
